JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: "A. Issue a Writ of Mandamus or such other Writ, Order or Direction to the Respondents to consider the Petitioners application for the renewal of his passport bearing No. N3273881 and consequently to renew the Petitioners Passport bearing No. N3273881 (Annexure-B). B. Pass such other order/s which this Hon'ble Court deems fit to under the facts and circumstances of the case, in the interest of justice and equity." 2. Smt.Reshma Thammaiah, learned ASG, submits that the application for renewal/re-issuance of the passport of the petitioner could not be processed on account of a charge sheet having been filed in a criminal proceedings in Crime No.208 of 2022 of the Kamakshipalya Police Station. She submits that the application could be only considered for issuance of a short validity passport and any travel by the - 3 - HC-KAR NC: 2025:KHC:42213 WP No. 29966 of 2025 petitioner would be subject to the permission being granted by the Court seized of the proceedings in Crime No. 208 of 2022. 3. In that view of the matter, I pass the following order. ORDER a) Writ petition is partly allowed. b) Respondents are directed to issue a short validity passport to the petitioner within a period of 2 weeks from the date of receipt of a copy of this order. c) Any travel by the petitioner shall, however, be subject to orders passed by the Court seized of the proceedings in Crime No.208 of 2022. d) Needless to say that the petitioner would have to keep informed the said Court of his proposed travel at least a week in advance and also inform the Court of his return within a week after his arrival within India.
