JUSTICE MOHAMMAD NAWAZ - 3 - HC-KAR NC: 2025:KHC:49883 CRL.P No. 4038 of 2025 ORAL ORDER Petitioner, being aggrieved by the registration of FIR in Crime No. 11/2025 at Banakal Police Station, Chikkamagalur for the offence punishable under Sections 118(1), 189(2), 190, 191(2), 329(3) and 352 of the BNS, 2023 has preferred this petition seeking to quash the FIR and complaint. 2. The respondent No.2 herein set the law in motion and based on his complaint, the above FIR came to be registered against the petitioner/accused No.1 and another named accused and 5 others. 3. The averments in the complaint reveal that the incident took place on 04.02.2025 at about 10.00 a.m. in a coffee estate situated in Survey No.76, Billur Village in Mudigere Taluk, wherein the accused are alleged to have picked up quarrel with the complainant and others and assaulted them with stones etc., when they were removing coffee seeds and putting up a fence. - 4 - HC-KAR NC: 2025:KHC:49883 CRL.P No. 4038 of 2025 4. From the averments in the complaint, there is a prima facie case against the petitioner. This Court cannot conduct a mini trial into the allegations. Investigation is in progress, which cannot be interfered. Further, in respect of the very same incident the petitioner herein has lodged a complaint with Banakal Police, which was registered in Crime No.10/2025 against accused Nos.1 to 9. It is submitted that in the said case charge sheet has been filed and same has been challenged before this Court in Crl.P.No.13292/2025. 5. Petitioner is at liberty to move this Court, in case the charge sheet is filed. With that liberty, petition is disposed of. I.A.No.2/2025 is disposed of.
