This criminal misc. application is filed under Section 528 of B.N.S.S. by the Applicants for quashing of the impugned charge-sheet dated 14.02.2025, cognizance/summoning order dated 19.05.2025, as well as the entire criminal proceedings of Criminal Case No.3232 of 2025 (Case Crime No.105 of 2024), titled as “State vs. Vaibhav Rawat & Others” pending in the court of 3rd Judicial Magistrate, District Dehradun for the offence punishable under Sections 109, 115(2), 191(2), 324(2) & 351(2) of B.N.S., at P.S. Clement Town, District Dehradun, in view of the compromise arrived at between the parties. 5. As per the order-sheet dated 22.05.2025, the Coordinate Bench of this Court had directed the learned counsel for the petitioners/accused to file ‘Medical Certificate’ of the injured and direction has also been passed for depositing `20,000/- each within a week to the High Court Legal Services Committee and as per order-sheet dated 02.06.2025, learned counsel for the Respondent no.3 Mr. Faizan Ali and learned counsel for petitioners Mr. Shakib Husain had submitted before the Court that the matter has amicably been settled between the parties and that respondent no.3 does not wish to prosecute the petitioners and in this light a 2025:UHC:5051 Compounding Application (IA No.01 of 2025) alongwith affidavits of the petitioners and respondent no.3 had been filed before the Court; directions were passed by the Coordinate Bench that the parties to appear before the Member Secretary, State Legal Services Authority, Uttarakhand, Nainital, who in turn would take their Aadhar Cards for identification and will verify and authenticate the contents of the compounding application by recording the statements of the parties. 6. Learned Member Secretary, State Legal Services Authority, Uttarakhand, Nainital has submitted his report dated 02.06.2025, which is part of the record, which clearly indicates that the parties have settled the dispute amicably and they do not want to agitate the matter further and have also verified the contents of the compromise. 7. In view of the above, Compounding Application (IA No.01 of 2025) is allowed. As a consequence thereof, the impugned charge-sheet dated 14.02.2025, cognizance/summoning order dated 19.05.2025, as well as the entire criminal proceedings of Criminal Case No.3232 of 2025 (Case Crime No.105 of 2024), titled as “State vs. Vaibhav Rawat & Others” pending in the court of 3rd Judicial Magistrate, District Dehradun for the offence punishable under Sections 109, 115(2), 191(2), 324(2) & 351(2) of B.N.S., at P.S. Clement Town, District Dehradun is hereby quashed. 8. Present criminal misc. application u/s 528 of B.N.S.S. is, thus, disposed of in terms of the compromise arrived at between the parties.
