Affidavit of service filed by the petitioner be kept with the record. 2. On being served the respondents are being represented. 3. The writ application has been preferred praying for direction for setting aside the purported “Reasoned Order” dated 15.09.2025 passed by the Sub-divisional Controller, Food and Supplies, Rampurhat, Birbhum. It is further stated that 2 2 the petitioner’s representation dated 24.06.2025 has been arbitrarily rejected and the FPS license granted in favour of the private respondent , Smt. Bilkis Begum, has been illegally sustained. . 4. In the present case the said reasoned order has been passed by the respondent no. 4 in compliance of the order passed by the High Court in WPA 14820 of 2025 dated 19.8.2025. The respondent no. 4 on conducting an enquiry has answered all the queries of the petitioner and on considering the same, by giving specific findings has passed a reasoned order against the petitioner herein. 5.Being aggrieved the petitioner has approached this Court once again challenging the said reasoned order on the ground that his application has been wrongly rejected and that the license granted in favour of the respondent no.l0 should be cancelled as the same has been unlawfully and illegally issued. 3 3 6. The petitioner has made allegations against the respondent no. 10 alleging that the property on which her godown is situated is on the basis of a forged and fabricated deed and as such the petitioner in prayer C and D to the writ application has prayed for a direction upon the Block Land and Land Reforms Officer, Murarai-I, to cancel the mutation order dated 27.08.2024 passed in Case No. MN/2024/0303/16080 in favour of the said Smt. Bilkis Begum, in exercise of the power under Section 50 (1)(f) of the West Bengal Land Reforms Act, 1955, as the same is based on a forged and fictitious Sale Deed No. 009594 dated 22.08.2024 purportedly registered at a non- existent registration office A.D.S.R., Sainthia. 7. On perusal of the materials on record, it appears that in respect of the deed on the basis of which respondent no. 10’s prayer for license was granted, an enquiry was 4 4 conducted by the Sub-divisional Controller and he has specifically held that on enquiry, the respondent no. 10 documents and papers were verified through available records and no evidence of fabrication could be established on the basis of the said records. 8. Considering the said fact this Court find no reason to pass any directions upon the Block Land and Land Reforms Officer as the issue involved therein is under the determination of another Bench of this Court. 9.Considering the petitioner’s prayer challenging the reasoned order, this Court prima facie finds no reason to interfere with the said order at this stage. 10. Writ application having no merit thus stands dismissed. 11.Parties to act on the server copy of this order. ( Shampa Dutt (Paul), J. )
