ORAL ORDER Heard Mr. Sudhanshu Jha, the learned advocate appearing for the petitioners and Ms. Foram Sukhadwala, the learned AGP appearing for the respondent State and its authorities, as also the learned advocate Mr. T.R.Mishra, who appears for the applicants of Civil Application No.1 of 2025, which has been )led seeking impleadment of the parties in the main Special Civil Application. 2. At the out set, learned advocate Mr. Jha for the petitioners would, under the instructions of his clients, submit that with the passage of time, the prayers sought for in this petition no longer survives and the present petition has become infructuous. He, accordingly, requests this Court to allow him to withdraw this petition as infructuous. 3. Per contra, learned advocate Mr. T.R.Mishra, though not appeared for any of the respondents in the main petition, but having )led the Civil Application to be joined as party respondents in this petition, pointed out that due to pendency of this petition, appointments given to his clients is in limbo and frivolous criminal cases have to be faced by them at the instance of the petitioners. 4. Having heard the learned counsels appearing for the respective parties, when the petitioners do not want to prosecute the present petition on the ground that it has become infructuous by e/ux of time, this Court cannot examine the merits/de-merits of the matter, except allowing the petitioners to withdraw the petition, as prayed for. 5. So far the grievance raised by the applicants of Civil Application No.1 of 2025, as voiced by the learned counsel Mr.
T.R.Mishra, is concerned, the same cannot be gone into by this Court in this matter. Nonethless, it is always open for the applicants to agitate such issues before the appropriate authority/court, if so advised. 6. With the aforesaid, the present petition is disposed of as having rendered infructuous. Notice is discharged. No costs. Page 2 of 3
