JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.5 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in C.C. No.36514/2024 pending on the file of XXXI Additional Chief Metropolitan Magistrate, Bengaluru registered for offences punishable under Sections 143, 144, 147, 148, 324, 326, 307, 504, 506 and 149 of Indian Penal Code and Section 25 of Indian Arms Act in Crime No.31/2019 of Bagalagunte Police Station. - 3 - HC-KAR NC: 2025:KHC:41742 CRL.P No. 11871 of 2025 2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. The petitioner was earlier granted bail by this Court in Criminal Petition No.2044/2019 vide order dated 10.05.2019. Thereafter, the petitioner did not appear before the Committal Court and therefore, the case against him came to be split up. In the split up case, NBW came to be issued against the petitioner and he has been secured by executing NBW and now he is in judicial custody since 21.07.2025. It is submitted that, the petitioner could not appear before the Committal Court due to COVID-19. The petitioner has undertaken to appear before the Committal Court and trial Court and cooperate for speedy trial. 4. Considering the fact that, the petitioner was earlier on bail and he undertaking to appear regularly - 4 - HC-KAR NC: 2025:KHC:41742 CRL.P No. 11871 of 2025 before the trial Court, he is entitled for grant of bail with conditions. In the result, I pass the following: ORDER This Criminal Petition is allowed. The petitioner/accused No.5 is granted bail in Crime No.31/2019 of Bagalagunte Police Station (pending in C.C. No.36514/2024 on the file of XXXI Additional Chief Metropolitan Magistrate, Bengaluru) and is ordered to be released on bail in the event his arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Jurisdictional Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the Trial Court on all the dates of hearing unless - 5 - HC-KAR NC: 2025:KHC:41742 CRL.P No. 11871 of 2025 exempted by the Court and cooperate for the speedy disposal of the case. iv) If the petitioner violates any of the above conditions, the prosecution is entitled to seek cancellation of his bail.
