CASE HAVING COME UP FOR ADMISSION ON 07.04.2025, THE COURT ON THE SAME DAY PASSED THE FOLLOWING: 2025:KER:29837 CRL.MC NO. 3311 OF 2025 2 ORDER Petitioner is an accused in Crime No.525 of 2023, registered at the Pattambi Police Station for offences under Sections 341, 323, 324, 308, 447 and 506 r/w Section 34 of IPC. On submission of final report, the case was numbered before the committal court and the case against all accused, other than the petitioner, was committed and is presently numbered as S.C.No.226 of 2024 on the files of the Assistant Sessions Court, Ottappalam. The petitioner’s absence at the committal stage has resulted in his case being included in the long pending register. 2. Learned counsel for the petitioner submits that his client had to leave India for taking up employment abroad and could not, therefore, appear at the committal stage. It is submitted that the petitioner is now in India. Petitioner is desirous of surrendering in court, but is apprehensive that his application for bail will not be considered on the day of surrender. 3. I heard the learned Public Prosecutor also. Considering the willingness to surrender expressed by the petitioner and the limited relief sought, the Crl.M.C. is disposed of as under; 2025:KER:29837 CRL.MC NO. 3311 OF 2025 3 i) The petitioner shall surrender before the trial court and move an application for bail, with advance notice to the Public Prosecutor, within two weeks. ii) If petitioner surrenders within the time granted, learned Magistrate shall pass orders on the bail application on the day of surrender itself. iii) Execution of the warrant pending against the petitioner shall be kept in abeyance for two weeks.
