JUSTICE J.M.KHAZI ORAL ORDER Learned counsel for the petitioner, learned counsel for respondent No.2 as well as learned High Court Government Pleader for respondent No.1/State are present. 2. The petitioner, respondent No.2 as well as CW-2-who is aggrieved person are present. 3. This petition is filed by the petitioner/accused under Section 482 of Cr.P.C, to quash the criminal proceedings in C.C.No.3075/2023, for the offences punishable 504, 509 and 354A of I.P.C. - 3 - HC-KAR NC: 2025:KHC:25714 CRL.P No. 10467 of 2023 4. A compromise petition is filed under Section 320(1) of Cr.P.C., for reporting settlement, duly signed by both the petitioner and respondent No.2 as well as CW-2. It is supported by affidavits of the petitioner/accused, respondent No.2/complainant and CW-2 who is aggrieved person. 5. The terms and conditions of settlement arrived at between the parties reads as under: "The petitioner and the respondent No.2 above named humbly submit as follows:- 1. The respondent No.1 have registered the above case against the Petitioner on the complaint of Respondent No.2 in their Cr.No.018/2023 for alleged offence punishable under sections 354(A), 504, 509 of IPC. After completion of investigation submitted charge sheet in CC. No.3075/2023 for the said offences on the file of 8th ACJM Court, Bengaluru city and the offences are compoundable. 2. The petitioner on aggrieved by the said preferred the above Criminal petition seeking quashing of the above proceedings against him. - 4 - HC-KAR NC: 2025:KHC:25714 CRL.P No. 10467 of 2023 3. That at the intervention of well-wishers and friends the respondent No.2 and the petitioner have settled their dispute out of court amicably and hence the Respondent No.2 have no intention to prosecute the petitioner any further in CC. No.3075/2023 pending on the file of Hon'ble 8th Addl.CJM Court, Bengaluru, accordingly the petitioner intend to close the above matter. WHEREFORE, the Petitioner and the Respondent humbly and respectfully prays that this Hon'ble court may be pleased to accord permission to compound the offences and to dispose off the above Criminal Petition in accordance with law, in the interest of justice and equity." 5. Respondent No.2/complainant and CW-2, who is aggrieved person admit the compromise and submits that they have no objection to allow the petition. The terms and conditions of compromise petition is legal and equitable.
