Petitioner is arrested on 05.06.2025 in connection with Crime No.151/2025 of Chitradurga Rural Police Station registered for offences punishable under Section 109, 125, 132, 3(5), 351(2) of BNS, 2023. - 3 - HC-KAR NC: 2025:KHC:30114 CRL.P No. 11213 of 2025 4. FIR is registered against accused Nos.1 to 3, on a complaint lodged by Divakara O., working as Assistant sub-Inspector at CEN Police Station, Chitradurga. 5. It is alleged that on 23.04.2025 at about 10.00 a.m., as he was directed by the Deputy Superintendent of Police to secure information about ganja peddlers, while he along with another police constable was near Kapra Petrol Bunk, Chitradurga, noticed accused Nos.1 to 3 at about 12.30 noon, coming on a black TVS Ntorq vehicle and when he tried to stop the said vehicle, instead of stopping, the rider of the two wheeler tried to hit him, with an intention to commit his murder. 6. According to the prosecution, the complainant was directed by the superior officer to collect information about the ganja peddlers and on receiving a credible information that the accused are coming on a two wheeler to sell ganja near Kapra Petrol Bunk, when he along with another police constable was waiting at service road, in - 4 - HC-KAR NC: 2025:KHC:30114 CRL.P No. 11213 of 2025 front of the petrol bunk, noticed accused Nos.1 to 3 coming on a two wheeler and when he tried to stop the vehicle, the petitioner herein, who was riding the motorcycle, instead of stopping the vehicle, tried to hit him with an intention to commit his murder. 7. Accused No.1 by name Suhail Khan was apprehended at the spot. It appears that on his voluntary statement, accused Nos.2 and 3 are named in the FIR. Petitioner was arrested on 05.06.2025. He is arraigned as accused No.2. Admittedly, no ganja or any other contraband is recovered from any of the accused. The allegations that the petitioner tried to hit the complainant with an intention to commit his murder, is a matter which has to be established during trial. The prosecution has to establish the ingredients of the offence alleged against the petitioner. The petitioner has been interrogated and not required for further interrogation/investigation. Accused Nos.1 and 3 are enlarged on bail by this Court in Crl.P No.9794/2025 dated 24.07.2025 and Crl.P No.8663/2025 - 5 - HC-KAR NC: 2025:KHC:30114 CRL.P No. 11213 of 2025 dated 11.07.2025. Apprehension of the prosecution can be taken care of by imposing necessary conditions. Hence, the following: ORDER i. Petition is allowed. ii. Petitioner/accused in Crime No.151/2024 of Chitradurga Rural Police Station, Chitradurga, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4.
