Page No.# 2/2 Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as they are apprehending arrest in connection with Patharkandi Police Station Case No. 324 of 2024 under Sections 126 (2), 118 (2), 109, 3(5) of Bharatiya Nyaya Sanhita, 2023 corresponding to G.R. Case No. 1903 of 2024.
2. Heard Mr. R.J. Baruah, learned Additional Public Prosecutor, Assam. Learned Additional Public Prosecutor has raised serious objection stating that the petitioners have caused grievous injuries on the head of Jakaria Ahmed as well as grave injuries on the face of the informant.
3. I have also scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the petitioners. I have considered the gravity of offence.
4. At this juncture, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioners.
5. Petition stands rejected at this stage.
6. In terms of the above observation, this Anticipatory Bail application stands
disposed of.
