Mr Mir Majid Bashir, the learned Counsel appearing for the Appellant, submits that the Appellant, who has been convicted vide Judgment dated 26th of December, 2019 by the learned Sessions Judge, Shopian in case No. 08/Sessions titled ‘State v. Ghulam Hassan Malik’, has passed away and, therefore, this appeal has been rendered infructuous. 02. Learned Counsel for the Appellant has, in this behalf, passed on a copy of the death certificate of the Appellant issued by the Registrar (Births and Deaths)/ Block Development Officer, Ramnagri, Shopian which is taken on record. He submits that the son of the deceased Appellant informed him about the death of the Appellant and provided him the aforesaid certificate relating to the death of the Appellant. 03. Mr Alla-ud-Din Ganai, the learned Additional Advocate General, representing the Respondent-Union Territory of Jammu & Kashmir, on instructions, submits that he has got the factum of the death of the Appellant confirmed from the concerned authorities. 04. In view of above, this appeal shall stand disposed of as abated. Crl Ref (L) No. 1/2020: 05. Having regard to Order passed in CrlA (D) No. 8/2020 hereinabove, the present Criminal Reference also does not survive and the same, too, shall stand disposed of as abated. 06. Registry to place a copy of this Order on both, CrlA (D) No. 8/2020 as well as Crl Ref (L) No. 1/2020.
