Mr. Manoranjan Jana ..for the petitioner Mr. Mukti Chandra Ghosh ..for the State Learned counsel appearing on behalf of the petitioner submits that the Pradhan, Chhatri Gram Panchayat, upon hearing the parties, detected an unauthorised construction at the behest of respondent no.8 and thereafter referred the matter to the Sub-Divisional Officer, Egra. However, these facts have not been pleaded in the present writ petition. In view thereof, I am not inclined to pass any order as prayed for in this writ petition. It is, however, clarified that if the matter has already been referred by the Pradhan in terms of Section 23(5) of the West Bengal Panchayat Act, 1973, to the concerned Sub-Divisional Officer, Egra, the said authority shall proceed in accordance with law. Accordingly, WPA 21920 of 2024 stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
