The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 21.02.2025 passed by Additional Session Judge, Court No. 14, Saharanpur in Criminal Revision No. 461 of 2024, whereby the revisional court set-aside the order dated 25.08.2023 passed by Additional Civil Judge-II, (Junior Division)/ Judicial Magistrate, Saharanpur in Complaint Case No. 1582 of 2023, whereby the learned Magistrate summoned the opposite party nos. 2 and 3 under Sections 323, 504, 506 of I.P.C. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
