Whereas, learned senior PCCG for the respondents No. 1 & 2, Mr. W. Darakeshwor and learned counsel for the State, Ms. Thanmiyo Keishing are present before this Court physically. Whereas, this miscellaneous case proceeding is initiated for seeking modification of the order dated 18.09.2024 rendered in PIL No. 11 of 2024. However, in the proceeding, direction had been given to implement the provisions of the Forest Right Act, 2006 in letter and spirit. Whereas, keeping in view of the provision of Article 226 of the Constitution of India, seeking for modification of order does not arise and consequently, this miscellaneous application proceeding stands dismissed. In the meanwhile, for the dismissal of the miscellaneous application proceeding, learned counsel for the applicant is seeking for liberty.
