The petitioner is before this Court seeking for the following reliefs: "a) Appoint a nominee Arbitrator on behalf of the Respondent, who in turn shall appoint the Chairman of the Arbitral Tribunal in consultation with the Petitioner's nominee arbitrator (in terms of clause 9 read with Attachment - 4 of the Distribution Agreement dated 18.01.2020 at Annexure -C) b) Award costs of this Petition to the Petitioner; and - 3 - HC-KAR NC: 2025:KHC:52909 CMP No. 96 of 2025 c) Pass any other order or orders as may be deemed fit, in the interests of justice and equity." 2. The learned counsel appearing for the petitioner has filed a memo dated 04.12.2025, seeking permission of the Court to withdraw the Civil Miscellaneous petition. The said memo reads as follows: "On behalf of the petitioner, the undersigned submits that the parties have settled their inter se disputes and the petitioner therefore seeks leave to withdraw the captioned petition. The same may kindly be taken on record, in the interests of justice and equity." 3.
