The petitioners have been made accused in connection with Jasidih P.S. Case No. 385 of 2024, for the offence registered under Section 103(1)/61 and 3(5) of the Bharatiya Nyay Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Deoghar. On 18.11.2024 at about 6:30 a.m., the informant came to know that his brother namely Deewana Yadav has been murdered and his dead body was lying by the side of Jaruwadih Road. The informant went to the place of occurrence and he saw that the throat of his brother was slit open. Learned counsel for the petitioners submitted that apart from the fact that the petitioners had talked to the deceased prior to the occurrence, there is no other material against them on record. Learned A.P.P on behalf of the State has opposed the prayer for bail and submitted that from the CDR report, it appears that petitioners had talked to the deceased several times prior to the occurrence. In view of the nature of allegation, I am inclined to release the petitioners, on bail.
