Khan, for the petitioner namely, Raju Borah @ Dilip Borah, who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind the bars since 24.01.2025 in connection with Dhemaji P.S. Case No. 09/2025, under Sections 329(4)/61(2)/326(f)/326(g) of Page No.# 2/3 BNS. Heard Mr. D. P. Goswami, the learned Additional Public Prosecutor, Assam. I have considered the submissions at the bar. The allegations against the petitioner is that he had a quarrel with the informant on 12.01.2025 and on 14.02.2025, the informant’s Maruti car bearing registration no. AS 22E 9949, one Royal Enfield Motor cycle bearing Registration no. AS 22 E 5245 and new scooty without registration no. were burnt. Strong suspicion rests on the petitioner owing to the quarrel, 2 days prior to the incident of arson. I have also scrutinised the Case Diary. Investigation has progressed substantially. The merits of the case are not brought to the fore, as investigation are still under progress. Considering all aspects, the petitioner is enlarged on bail of Rs.30,000/- (Rupees Thirty Thousand only) with one suitable surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhemaji under the conditions :- i) That the petitioner shall appear before the I.O on every fortnight till the completion of the investigation; ii) And the petitioner shall not leave the jurisdiction of the Court without prior permission. On breach of any of the bail conditions, the learned jurisdictional Court/Elaka Magistrate is at liberty to cancel the bail granted to the petitioner. Send back the Case Diary.
