The first bail application of the applicant has been dismissed as withdrawn vide order dated 27.11.2024 passed in MCRC No.5377 of 2024. 2. Learned counsel for the applicant would submit that from the evidence of the witnesses no prima facie offence is made out against the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.03.04 15:02:42 +0530 2 applicant and he is in jail since 11.06.2024. Therefore, looking to his detention period he has filed the second bail application. 3. On the other hand, learned counsel for the State opposes. 4. Considering the submissions made by learned counsel for the parties, further considering that the first bail application of the applicant has been dismissed as withdrawn on 27.11.2024, no liberty was granted to the applicant further that the victim has already been examined much prior to the rejection of his first bail application i.e. on 26.09.2024 and therefore, I do not find any ground to change in circumstance. 5.
