Neutral Citation No. - 2025:AHC:103323 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 6287 of 2025 Petitioner :- Vijay Singh Chauhan Respondent :- Kumari Dharmvati And Another Counsel for Petitioner :- Sapna Singh Counsel for Respondent :- Kaushalendra Nath Singh Hon'ble Manish Kumar Nigam,J. This petition has been filed challenging the order dated 27.05.2025 passed by the Civil Judge, Senior Division, Gautam Budh Nagar in Original Suit No.234 of 2024. By the order impugned, the application Paper No.26
ग under Section 151 CPC has been
directed to be decided after service upon the other side. From the perusal of record, it is apparent that the initial injunction application filed by the petitioner under Order 39 Rule 1 and 2 CPC being Paper No.6-C is also pending and the opposite parties have appeared and filed their objections. Since, the original application is pending consideration before the trial court, it would be expedient in the interest of justice that the application for temporary injunction Paper No.6-C, which is pending before the trial court, be decided expeditiously preferably within period of 8 weeks from the date of production of certified copy of this order in accordance with law after providing opportunity of hearing to all the parties concerned. It is made clear that this Court has not examined the matter on merits and the trial court is directed to decide the matter strictly in accordance with law. With the aforesaid observation, the writ petition stands disposed of.
