At the very outset, Sri Brajesh Kumar Singh, learned counsel for the applicants seeks to withdraw the present application wherein the challenge has been raised in summoning order dated 15.06.2024 passed by the Court of learned Judicial Magistrate, Firozabad in Complaint No.75478 of 2023 (Smt. Musarrat Vs. Kalimudeen and others), under Section 323 I.P.C. against the applicant nos.1, 2 and 3, under Section 323, 354B I.P.C. against the applicant no.4 and 5 and under Section 323, 506 I.P.C. and Section 3/4 Muslim Women Protection Act against the applicant no.6, Police Station-Uttar, District Firozabad as well as entire proceeding of Complaint No.75478 of 2023 (Smt. Musarrat Vs. Kalimudeen and others), under Section 323 I.P.C. against the applicant nos.1, 2 and 3, under Section 323, 354B I.P.C. against the applicant no.4 and 5 and under Section 323, 506 I.P.C. and Section 3/4 Muslim Women Protection Act, Police Station-Uttar, District Firozabad, pending in the Court of learned Judicial Magistrate, Firozabad on the basis of compromise dated 11.12.2024 on account of incurable technical defects with liberty to file afresh. 2. Learned AGA has no objection to the same. 3. The application is dismissed as withdrawn with liberty aforesaid. 4. When afresh application is preferred, before the filing of afresh application a copy be served upon the counsel appearing for the opposite party no.2 Sri Rajendra Singh Yadav 5.
