ORAL ORDER
The petitioner/accused No.1 has filed the captioned petition seeking quashing of the proceedings pending in C.C.No.99/2018 on the file of I Addl. Senior Civil Judge and CJM, Mysuru, for the offences punishable under Sections 406 and 420 of IPC.
2. Today, a joint memo/application duly signed by both the parties as well as their respective learned counsel has been filed before this Court. In the said joint memo, it is stated that the matter has been amicably settled

between the parties and that the petitioner/accused No.1 has given a quietus to the dispute by paying a sum of Rs.6,00,000/- (Rupees Six Lakhs only) to respondent No.2/complainant by way of demand draft.
3. Along with the joint memo, affidavits sworn to by the petitioner/accused No.1 and respondent No.2/complainant are also annexed. In his affidavit, the complainant, namely, Sri Jayaramu, S/o Late Putte Gowda, has categorically acknowledged that the matter has been amicably settled, that he has received a sum of Rs.6,00,000/- as full and final settlement, and that he has voluntarily agreed to compound the offences which are the subject matter of C.C.No.99/2018.
4. Today, in open Court, learned counsel for the petitioner has handed over the original demand draft for a sum of Rs.6,00,000/- to the learned counsel appearing for respondent No.2/complainant. A photocopy of the said demand draft has also been placed on record. Respondent

No.2 has acknowledged receipt of the same through his
learned counsel.

In view of the fact that the offences punishable under Sections 406 and 420 of IPC are compoundable in nature, and as the parties have amicably resolved their differences, the joint request made by the petitioner and respondent No.2 to compound the offences deserves to be accepted. Continuance of the criminal proceedings in such circumstances would serve no purpose and would amount to unnecessary prolongation of litigation.
6. Accordingly, the joint memo filed by the parties is accepted. Consequently, the criminal proceedings initiated against the petitioner in C.C.No.99/2018 are liable to be quashed.
7. For the foregoing reasons, this Court proceeds to pass the following:
ORDER (i) The Criminal Petition is allowed.

(ii) The proceedings in C.C.No.99/2018 for the offences punishable under Sections 406 and 420 of IPC, pending on the file of the I Additional Senior Civil Judge and Chief Judicial Magistrate, Mysuru, in so far as the petitioner is concerned, are hereby quashed.
