Hon'ble Praveen Kumar Giri,J. 1. Heard Sri Anoop Kumar Dubey, learned counsel for the petitioner, Sri Suresh Singh, learned Additional Chief Standing Counsel for the State respondent, and Sri Pankaj Srivastava, learned counsel for the respondent Purvanchal Vidyut Vitran Nigam Limited. 2. Learned counsel for the petitioner states that the petitioner is a proprietorship firm engaged in the business of performing government contracts in electrification. In view of the tender awarded and floated by respondent no. 4, the award was accorded in favour of the petitioner for the work of Construction of 11KV Underground Line for 33/11 KV Sub- Station Radha Nagar for re-grouping of 11 KV Feeders (site) nearby 220 KV S/S Radha Nagar, District Fatehpur. 3. Learned counsel for the petitioner states that even though the petitioner had performed the work but till date the authority has not processed the bill and not accorded the relief as is being prayed for. The relief is pressed in the light of the judgment passed by the Hon'ble Apex Court in M/s Surya Construction vs. State of Uttar Pradesh & Ors. (2019) 16 SCC 794. 4. Per contra, Sri Pankaj Srivastava, learned counsel for the contesting respondent, has placed the communication dated 31.07.2025 sent by the Executive Engineer, Electricity Secondary Works Division, Purvanchal Vidyut Vitaran Nigam Ltd., Prayagraj which is taken on record. He submits that the process is ongoing to clear the bills as admissible in terms of the agreement. He submits that some time may be accorded to place on record the said decision of the authority. 5. Considering the factual situation, we are not inclined to keep the matter pending consideration as the relief prayed for is in consonance with the law propounded by the Hon'ble Apex Court in M/S Surya Construction (supra). 6. Accordingly, the writ petition stands disposed of with the observation that the competent authority must process the claim of the petitioner, strictly, in accordance with law, within two months from the date of production of a certified copy of this order. 7. Needless to say, we have not expressed any opinion on the merits of the case. Order Date :- 18.8.2025 K.K. Maurya Digitally signed by :- KAMLESH KUMAR MAURYA High Court of Judicature at Allahabad
