Dixit, Additional Chief Standing Counsel for the respondent no.1 to 6. 2. The petitioner by means of the present writ petition has prayed for following reliefs:- "(i). Issue a writ, order or direction in the nature of mandamus directing the respondent authorities not to interfere in peaceful possession of the petitioner and Proforma respondent No.7 to 12 who are also rightful owners of Plot No. 403, Area 0.214, 416, Area 0.312, 423, Area 0.202, 424, Area 0.227, 425, Area 0.105, 462, Area 0.089, 463, Area 0.081 and 482, Area 0.166, total 8 Plots Area 1.396 Hectare situate in Village Sonakpur, Tehsil and District Moradabad which has been mentioned in Khatauni Khata No. 19 of 1402 Fasli in the name of father of petitioner and his uncle Laxmi Chand. (ii). Issue a writ, order or direction in the nature of mandamus to restrain the answering respondents not to construct building for office of respondent No.5 over above mentioned plots. (iii). Issue a writ, order or direction in the nature of mandamus direct the respondent No.1 to decide the application/representation dated 6.6.2025 filed by the petitioner before the Hon'ble Chief Minister, U.P. Lucknow and the copy of the same has been forwarded to the respondent No.1. (iv). Issue any suitable writ, order or direction which this Hon'ble Court may deem fit Versus Counsel for Petitioner(s) : Kamala Kant, Vidya Dhar Yadav Counsel for Respondent(s) : C.S.C. Dileep Singh .....Petitioner(s) State Of U.P. And 11 Others .....Respondent(s) and proper in the facts and circumstances of the case. (v). Award the cost of the writ petition in favour of the petitioner." 3. This court on 10.07.2025 sought instructions from respondents. 4. Sri V.K. Dixit, Additional Chief Standing Counsel for the respondent no.1 to 6 on instructions which is taken on record states that the office of the home guard is being constructed over plot no.363, situated at Village- Sonakpur, Pargana-Tehsil, District-Moradabad. The Petitioner is not the owner of plot no.463. As per instructions the State denies the fact that the State is interfering in the peaceful possession of the petitioner. Paragraph nos.6 to 8 of the instructions are reproduced herein below: "6. यह िक यािचकाकतार् एवं कु छ अन्य लोग होमगाडर् िवभाग की उपरोक्त आराजी गाटा संख्या-363 पर हो रहे िनमार्ण कायर् में व्यवधान उत्पन्न कर रहे है और मौके पर होमगाडर् िवभाग की भूिम गाटा संख्या-363 पर गाटा संख्या-463 आिद होना बताते है। 7. यह िक होमगाडर् िवभाग के पत्रांक संख्या-481/भवन पत्रा०/2015 (पाटर्-2) िदनांक 14 जुलाई 2025 के माध्यम से यह अवगत कराया गया है िक गाटा संख्या-363 पर िनमार्ण कायर् चल रहा है, िजसमें स्वीकृ त मानिचत्र के अनुसार भवन की नींव का कायर् पूणर् हो गया है। भूिम से सतह से लगभग 04 िफट की ऊचाई तक दीवारें बन चुकी है। इसके ऊपरी िहस्से में दीवार की िचनाई हेतु िपलर बनाये जा रहे है। होमगाडर् िवभाग के पत्र की छायाप्रित। (संलग्नक-3) 8. यह िक यािचकाकतार् का यह कथन िक उसके शािन्तपूणर् कब्जे में हस्तक्षेप िकया जा रहा है, कतई गलत है। क्योंिक यािचकाकतार् का नाम गाटा संख्या-463 आिद पर दजर् नहीं रहा और न ही वतर्मान में अिभलेखों में दजर् है और यािचकाकतार् का मौके पर भी िकसी भी गाटा संख्या पर कोई कब्जा नहीं है।" 5. Since the writ petition involves disputed question of facts as to whether the construction of office of home guard is being raised over the plot no. 363, situated at Village-Sonakpur, Pargana-Tehsil, District-Moradabad owned by the petitioner and the said issue can be decided on the basis of pleadings and assessment of evidence on record. 6. In such view of the fact, the writ petition is misconceived, and is dismissed with liberty to the petitioner to avail appropriate remedy available in law.
