It is further stated that the victim seems to be the consenting party, as is evident from the fact that she had taken away cash and ornaments from her house. The prosecution story stands completely transformed in her statement recorded u/s 164 Cr.P.C., whereby she has stated that the applicant had stolen her ornaments and money, as such, called her to Etah bus stand to return the said amount and ornaments and had forcibly taken her away and raped her. 7. Considering the facts and circumstances of the case, submissions made by learned counsel for the parties, the evidence on record, the delay in institution of FIR and there being no recovery of cash or ornaments from the applicant, without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed. 11. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted. 13.
