JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Learned counsel for the petitioner has filed a memo seeking leave of the Court to withdraw the petition on the premise that the dispute between the parties is settled before the Trial Court. Along with memo the order passed before the Trial Court is also produced. 2. An application is also filed seeking leave of the Court to withdraw the amount in deposit before this Court. 3. Learned counsel for the petitioner would submit that the respondent has accepted Rs.30.00 lakhs as full and final settlement of the claim against the petitioner and in that view of the matter, the respondent is not entitled to the amount in deposit before this Court which is passed pursuant to the interim order passed by this Court. 4. Notice is issued to the respondent. Respondent has not entered appearance and the endorsement is received - 3 - HC-KAR NC: 2025:KHC:37207 CRL.RP No. 1532 of 2024 stating that respondent has left the address. Notice is issued to the same address to the respondent before the Trial Court. 5. Since memo is filed reporting settlement recorded by the Trial Court, this Court do not find any reason to reject the application of the petitioner seeking leave of the Court to withdraw the amount. Application is allowed. Amount in deposit shall be released in favour of the petitioner. 6. Since the dispute between the parties is settled, petition is dismissed as withdrawn.
