ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs: a. Issue appropriate writ or order to quash the order as per Annexure-F dtd: 23.12.2024 passed by the court of the vii addl. district and sessions judge, Tumakuru filed by the petitioner under order 7 rule 11 of CPC read with Sec 166(3) (amendment act 2019) in MVC No.884-2024.
b. Allowing the application filed by the 1st respondent under Sec 5 of the limitation act as per Annexure-B and hold that claim petition as per Annexure-A is not maintainable.
c. Pass such other writ or order or orders is this Hon'ble court deems fit under the facts and circumstances of the case, in the interest of justice and equity.
2. A memo dated 08.12.2025 has been filed signed by the learned counsel for the petitioner, which reads as under; Memo for withdrawal
The petitioner prays that this Hon’ble High Court pleased to dismiss the writ as not maintainable. Since the Tribunal has passed the final order.
