JUDGMENT
Devan Ramachandran, J. After arguing this matter for some time, Sri.Abraham George Jacob – learned counsel for the petitioner, submitted that his client has approached this Court because she was under the impression that the learned Family Court will not call for the report from the Forensic Science Laboratory, in spite of his request to do so through IA No.23/2024. He explained that his client bona fide believes that IA No.23/2024 has been, therefore, dismissed.
2. However, when we alerted Sri.Abraham George Jacob that the impugned order merely says that the stage is premature; and that the petition has not been considered on its merits, thus leaving liberty to the parties to invoke
2025:KER:29734 OP (FC) NO. 209 OF 2025 -3- any remedy that may be available at the relevant time, he sought permission to withdraw this Original Petition with liberty to approach this Court again, if so required. In the afore circumstances, this Original Petition is dismissed as having been withdrawn, with every liberty available to the parties in law being expressly kept open.
