The writ petition seeks quashing of the F.I.R. dated 20.05.2025 giving rise to the Case Crime No. 0278 of 2025, under Sections 70(2), 351(2), 123, 61(2) of B.N.S and Section 3/4(2) Protection of Children from Sexaul Offences Act, 2012 and Section 67 I.T. Act, Police Station- Amroha Nagar, District- Amroha. 3. The petitioner is a minor. The allegation against the petitioner is that she took the daughter of respondent no.3 to her house where her cousin committed the offence of rape against her and made her incriminating video viral. 4. Learned counsel for the petitioner submits that petitioner is a minor and she has been falsely implicated. 5. Learned counsel for respondent no.3 submits that the petitioner is main culprit, who was instrumental in getting the alleged offence committed against the daughter of respondent no.3. 3. With regard to the allegation made in the first information report police investigation is under way. 4. For the reasons given in the judgment of this Court dated 10.07.2024 passed in Criminal Misc. Writ petition No. 7463 of 2024 (Shobit Nehra And Another Vs. State of U.P. and 2 Others) the writ petition is disposed of directing that till cognizance is taken on police report under Section 193(3) B.N.S.S., by the court the respondents shall not arrest the petitioner pursuant to the F.I.R. dated 20.05.2025 subject to cooperation in ongoing investigation.
