Mr. D.C.S. Rawat, learned counsel for the petitioner. 2. Mr. Bhaskar Chandra Joshi, learned A.G.A. for State of Uttarakhand/ respondent Nos.1 to 4. 3. Delay in filing the Supplementary Affidavit is condoned. Supplementary Affidavit filed by the State is taken on record. Delay Condonation Application (IA/1/2025) made therefor, is allowed. 4. By means of the present criminal writ petition, petitioner has prayed for following reliefs: “(a) directing the respondent No.2 to ensure that a proper, fair, and time-bound investigation is conducted in F.I.R./ Case Crime No.1 of 2021, registered under Sections 147, 323, 392, 457, 504 IPC at Patwari Circle- Malli Riyuni, Tehsil-Ranikhet, District-Almora; (b) directing the respondent Nos.3 and 4 to submit a detailed affidavit and investigation record relating to the said case, along with status of any final report/ charge sheet; (c) directing the initiation of appropriate departmental action against the respondent No.4 for dereliction of duty;” 5. This Court has called the Investigating Officer-respondent No.4 vide order dated 04.06.2025 feeling that the approach of the IO in not filing the progress report is very callous. The IO-Mr. Surendra Singh Bisht was present before this Court on 06.06.2025 and he submitted to the Court that after investigation, the charge-sheet has been submitted by him in the office of Naib Tehsildar, Ranikhet and APO, 2025:UHC:5068 Ranikhet and the said charge-sheet appears to have been misplaced in the office of Naib Tehsildar, Ranikhet and APO, Ranikhet and he sought for and was granted 10 days’ time to bring on record the said charge-sheet by filing a Supplementary Affidavit and fixed this case for today i.e. 18.06.2025. 6. Today, the IO-Surendra Singh Bisht is present before this Court and informed this Court that the supplementary affidavit has been filed annexing the copy of charge-sheet dated 23.04.2021, by which the respondent No.5-Veer Singh@Veeru, respondent No.6-Lalit Singh Adhikari, respondent No.7-Rahul Singh Rawat and respondent No.8-Harshit Adhikari was charge-sheeted under Sections 323, 504, 457 IPC. 7. In view of the said charge-sheet having been filed after investigation, nothing remains to be decided in the present criminal writ petition. However, since the charge-sheet has been filed in the year 2021, it is expected from the respondent-State to initiate proceedings immediately against the charge-sheeted persons in accordance with law. 8. In view of the above, the present criminal writ petition is hereby closed.
