Neutral Citation No. - 2025:AHC:99293-DB Court No. - 64 Case :- WRIT - C No. - 20134 of 2025 Petitioner :- Jharkhand Bahadur Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Debee Shanker Pandey,Shivendra Nath Singh Counsel for Respondent :- C.S.C. Hon'ble Jayant Banerji,J. Hon'ble Madan Pal Singh,J.
1. Heard learned counsel for the petitioner and the learned Standing Counsel, appearing for the State-respondents.
2. By means of this petition, the petitioner seeks to challenge an advertisement dated 2.4.2025, issued by the Block Development Officer, Ghorawal, District Sonbhadra for purpose of renewal of registration of the Firm of the contractors for the financial year 2025-2026. Further under challenge is a tender notice dated 3.6.2025, issued by the office of Block Development Officer, Ghorawal, District Sonbhadra.
3. The contention of the learned counsel for the petitioner is that the petitioner's firm is registered as a 'D' class contractor with the office of the Executive Engineer, Rural Engineering Department, Sonbhadra, which registration is valid till 30.6.2027. It is stated that character certificate is valid till 4.9.2025 and the status certificate is valid till 6.1.2028. Learned counsel has referred to a Government Order dated 16.8.2019 to contend that the contractor, who is registered in one department of the government, subject to appropriate eligibility, would be entitled to participate and submit bids in the tender process floated by another department of the government.
4. Learned Standing Counsel has opposed the writ petition on the ground that the petitioner was a prospective candidate for the aforesaid tender notice, who had actually not participated in the tender aforesaid.
5. A perusal of the tender notice dated 3.6.2025 reflects that the tender documents were required to be opened on 20.6.2025. It is admitted to the counsel for the petitioner which is also reflected in paragraph no. 17 of the writ petition that the petitioner had not participated in the tender process, but was a prospective candidate. The petitioner having not participated or submitted his bid in the
aforesaid tender process, cannot claim that he was not permitted to participate in the tender process.
6. In the facts and circumstances of the case, the petition of the petitioner is thus clearly not maintainable. This petition is, therefore, dismissed. Order Date :- 24.6.2025 sfa/ (Madan Pal Singh, J) (Jayant Banerji, J) Digitally signed by :- SYED FAHEEM AHMAD High Court of Judicature at Allahabad
