ORAL ORDER
Parties present. There is no possibility of amicable settlement.
2. Petition is filed under Section 24 of the Code of Civil Procedure, with the following prayer:
“In view of the aforesaid facts, reasons and related circumstances of the case, it is respectfully prayed that this Hon’ble Court be pleased to pass an order for: (a) WITHDRAWING the case in M.C.No.230/2025 on the file of the Hon’ble Family Court at Shivamogga and transfer the same to Family Court at Bengaluru vide Annexure-D.”

Facts in a nutshell are as under: Respondent/husband filed a petition for divorce in M.C.No.230/2025 on the file of the Family Court at Shivamogga, whereas, petitioner/wife had filed Crl.Misc. No.79/2025 under Section 12 of the Protection of Women from Domestic Violence Act, 2005, and also a petition for divorce on the file of the JMFC (Traffic Court-VI), Bengaluru.

4. Now, wife wants the petition filed by the husband at Shivamogga to be transferred to the Court at Bengaluru to be tried along with petition for divorce filed by her.
5. Since both the parties have filed petition for divorce, any of the parties can appear through video conferencing and file appropriate statement before any one of the Courts and obtain necessary Orders.
6. Geographical distance and financial constraints are no longer valid grounds for transfer of case from one Court to another, in view of the videoconferencing facility now available.
7. If any of the parties in any of the proceedings apply for effective participation through video conferencing, learned Trial Judges in each of the Courts may permit the parties to utilize the videoconferencing facility.
8. Parties may also explore the possibility of settlement in the pending proceedings.
