The present bail application has been moved by the applicant- accused Sunil Kumar for the offence punishable under Sections 318(4). 338, 336(3). 340(2) B.N.S. and Section 3/25 Arms Act in Case Crime No. 87 of 2025, Police Station- Kishni, District Mainpuri. 2. Mr. Sarvesh Kumar Dubey, learned advocate, appears on behalf of applicant and submits that accused-applicant has been falsely implicated in the present case on the statement of co-accused, who have already been granted bail. The role of the accused-applicant is that co-accused has named the accused-applicant and one co- accused Jabar Singh that they used to provide forged gun license. The charge sheet has been submitted in the matter against the accused-applicant. The arrest and recovery has been made in absence of independent witness. The accused-applicant is in jail since March, 2025. 3. Per contra, learned AGA opposed the prayer for bail and submits that accused-applicant is having the criminal history, who is involved in an organized crime of providing license to the other co-accused. The accused-applicant has been apprehended at the time of checking. The charge sheet has been submitted in the matter. 4. Taken into consideration the rival submissions made by the parties and perused the record. 5. The perusal of the record reveals that the accused-applicant has not been apprehended at the place of arrest and recovery. The charge sheet has been submitted in the matter. The name of the accused-applicant is figured out during the arrest of co-accused on their statement. The accused-applicant is languishing in jail since March, 2025. Without touching the merit of the case, this bail application is allowed. 6. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
