ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of the 2nd respondent the Greater Visakhapatnam Municipal Corporation insisting petitioner to take Fir No Objection Certificate every year by paying fee as per G.O.Ms.No.71 as illegal, arbitrary, unconstitutional and contrary to Andhra Pradesh Fire Service Act, 1999 and its Rules and consequently direct the 2nd respondent to grant license as per Section 17 of the Act and grant such NOC and pass such other orders....”
2. Heard Mr. S. Nageswar Reddy, learned counsel for the petitioner and learned Standing Counsel for the Respondents.
3. During hearing learned counsel for the petitioner would contend that this matter is squarely covered by an order of this Court, dated 19.04.2023 in W.P.No.8476 of 2016 and batch and requested to pass similar order in this writ petition also. Learned Standing Counsel for the respondents conceded the same.
4. Considering the submissions of learned counsel, this Writ Petition is
disposed of in terms of the order passed in W.P.No.8476 of 2016 and batch, dated 19.04.2023. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall also stand closed.
