The petitioners' case is that the petitioner no.1 is already married and without seeking divorce she is performing second marriage. 3. In absence of any decree of divorce and as such no prayer preferred at the behest of the petitioner no.1, the instant petition is not maintainable and may not be considered by this court. Although none appeared for petitioner no.1 and on the basis of documentary evidence, which has been brought to the notice of this court, no prayer can be accepted through the instant petition which is liable to be dismissed. 4.
