ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioners seek the following reliefs:
“(a) The Issue a Writ of Mandamus, directing the 3rd respondent-Registrar (Administration), Bengaluru City University, Dr. Ambedkar Veedhi, Bengaluru-560 001 not to give effect to the representation dated 22.02.2025 vide Annexure-D and the representation dated 29.08.2025 vide Annexure-E and not to sanction any permission to close B.Ed., Course in Bharath Education Society, No.27, 16th Main Road, 4th Block, Jayanagar, Bengaluru-560 011; (b) Issue a Writ of Mandamus, directing 2 respondent The Commissioner, Collegiate Education, Seshadri Road, Bengaluru-560 001 sanction grant in
order to run B.Ed., Course in Bharath Education Society, No.27, 16 Main Road, 4% Block, Jayanagar, Bengaluru-560 011; (c) Issue a Writ of Mandamus, directing the 4 respondent- The Joint Director, Central Admission Cell (CAC), K.G. Road, Bengaluru-560 009 to include

(d) Issue a Writ of Mandamus, directing the respondents 2 and 3 to consider the representations dated 18.09.2025, acknowledged on 19.09.2025 vide Annexures-H1 and H2 made by the Members of the Managing Committee of Bharath Education Society, No.27, 16th Main Road, 4th Block, Jayanagar, Bengaluru-560 011 and to instruct the respondents 5 and 6 not to close B.Ed., Course, in the interest of justice and equity. e) Issue a Writ of Mandamus, directing the 3rd respondent- The Registrar (Administration), Bengaluru City University, Dr. Ambedkar Veedhi, Bengaluru-560 001 to write a letter to the 4th Respondent- the Central Admission Cell to add the institution i.e., Bharath Education Society, No.27, 16th Main Road, 4th Block, Jayanagar, Bengaluru- 560 011 to add the said institution in the list and to allot 38 students for the 1st year B.Ed., in the interest of justice and equity. (f) Pass such other order/s or directions as this Hon'ble Court may deems fit to grant such further reliefs by considering the facts and circumstances of this case and an order as costs to meet the ends of justice and equity.”
2. Heard the learned counsel for the petitioners, learned HCGP and learned counsel for the respondents and perused the material on record. - 6 -

A perusal of the material on record would indicate that on 22.02.2025 and 29.08.2025, respondent Nos.5 and 6 submitted representations dated 22.02.2025, and subsequent representation including representation dated 29.08.2025 requesting the third respondent – University for permission to close B.Ed course for the academic year 2025-2026 onwards, in respect of respondent Nos.5 to 8.
In the meanwhile, the petitioners who are life members of the fifth respondent - Society and the impleading applicant who are committee member contend that if respondent No.3 – University were to accept the request made by the respondent Nos.5 to 8 and close the said course, some of the students studying would be put to irreparable hardship. 4. The said submission is made on behalf of the petitioners and the impleading applicant, which is vehemently opposed / refuted by the learned counsel for the respondent Nos.5 to 8 who submits that the Central Administrative Cell of the third respondent – university

HC-KAR NC: 2025:KHC:47818 WP No. 33910 of 2025 has not allotted any seats for the students of B.Ed course for the academic year 2025-2026. 5. The learned counsel for respondent No.3 – university submits on instructions that subsequent to the aforesaid representation submitted by the respondent nos.5 to 8 for closure of B.Ed course for the academic year 2025-2026 onwards, the third respondent - university has not taken any decision in this regard so far and the same would be taken after providing an opportunity of hearing to the petitioner, impleading applicant as well as respondent Nos. 5 to 8 and proceed further in accordance with law. 6. In view of the aforesaid
facts and circumstances, though several contentions are urged by the petitioners and impleading applicant on one hand and respondent Nos.5 to 8 on the other, without expressing any opinion on the merits / demerits of the rival claim, I deem it just and appropriate to dispose of this petition directing the third respondent - University to consider the

HC-KAR NC: 2025:KHC:47818 WP No. 33910 of 2025 representation of the respondent Nos.5 to 8 for closure of B.Ed course for the academic year 2025-26 by providing an opportunity to respondent Nos.5 to 8, as well as the petitioner and also the impleading petitioner and take appropriate decision in this regard as expeditiously as possible in accordance with law, within a period of four weeks from the date of receipt of copy of this order.
7. All rival contentions between the petitioner, impleading applicants and respondent Nos.5 to 8 are kept open and no opinion is expressed on the same.
