ORDER This petition has been filed challenging the order passed by the second respondent in Na.Ka.No.60/PVKCO/N.Ref/2025, whereby, the second respondent police refused to grant permission to conduct the festival i.e. Adal Padal as prayed for in the present Writ Petition. 2 Heard both sides and perused the materials available on record. 3 It is seen that on behalf of his village, the petitioner made a representation dated 11.06.2025 before the second respondent police seeking permission and protection to conduct cultural programme in the event of “Sri Kamalavinayar Thiruvizha”, but the same was rejected by the second respondent vide its impugned proceedings dated 12.06.2025. W.P.(Crl.).No.104 of 2025 4 Learned Government Advocate (Crl.Side) for the respondents has fairly conceded that the reasons given in the impugned
order for rejection are unreasonable. 5 Therefore, the impugned order dated 12.06.2025 passed by the second respondent is hereby quashed. 6 The respondent police is directed to grant permission and to provide adequate police protection for the "Aadal padal programme" to be conducted on 20.06.2025 during night time from 07.00 P.M. to 11.00 P.M. on the event of "Sri Kamalavinayar Thiruvizha" subject to the following conditions: (a) the Aadal padal programme scheduled to be held on 20.06.2025 should be completed before 11.00 p.m. midnight or within the time permitted by the respondent police. (b) There should not be any kind of obscene dance or vulgar dialogues during the performance, by anyone of the participants. 3/6 https://www.mhc.tn.gov.in/judis
W.P.(Crl.).No.104 of 2025 (c) Double meaning songs should not be played so as to spoil the minds of students and youths. (d) No dance or songs, touching upon any political party or religion or community or caste shall be played. (e) No flex boards in support of any political party or communal leader, shall be erected at the premises of the programme. (f) The function shall not affect either religious or communal harmony and shall be conducted without any discrimination based on caste. (g) If there is violation of any one of the conditions imposed, the concerned police officer is at liberty to take necessary action, as per law and stop such performance forthwith; and (h) Similarly, the police is directed to stop the dance programme, if it is played beyond the permitted time limit. (i) The respondent is directed to issue necessary permission, incorporating the above conditions. 7 It is open to respondent police to put any further restrictions or to impose any conditions purely in the interest of preserving 4/6 https://www.mhc.tn.gov.in/judis
W.P.(Crl.).No.104 of 2025 public peace and tranquility. 8 This Writ Petition (Criminal) shall stand disposed of with the above observations and directions. Since the writ petition itself
disposed of by this order, no order is required to be passed in the miscellaneous petition seeking dispense with the production of original impugned order dated 20.06.2025 and the same is closed.
