11.11.2025 rpan/01 MAT 1867 of 2025 + IA No.: CAN 1 of 2025 Abhik Chakraborty – Versus – The State of West Bengal & Others
Mr. Sudipta Dasgupta, Ms. Sinjini Chakraborti, Mr. Arindam Shit … for the Appellant. Mr. Rajarshi Basu, Mr. K. M. Hossaian … for the State/Respondents. Dr. Sutanu Kr. Patra, Ms. Supriya Dubey … for the WBCSSC.
The present appeal has been preferred to assail the
order dated 24th October, 2025, passed in W.P.A. 23372 of 2025, whereby the writ petition was dismissed. The appellant is pursuing the Teacher Training Course [D.Ed. (Special Education)] and, according to him, under the extant rules, he is entitled to participate in TET 2025, which is to be conducted for filling up the posts of Special Education Teachers. Mr. Dasgupta, learned advocate appearing for the appellant, submits that in a writ petition involving a similar issue, a learned Single Judge of this Hon’ble Court
directed the concerned authority of the West Bengal School Service Commission to permit the petitioners therein to submit their applications in offline mode and to proceed accordingly. In the present case, the writ petitioner/appellant was denied permission to participate in TET 2025, as the writ petition could not be taken up for hearing before 24th September 2025, which was the last
date for submission of applications, although it had been filed two days earlier. Taking into account that the appellant’s grievance is confined solely to the denial of his right to participate in TET 2025 pursuant to the notification dated 9th September 2025, and since Dr. Patra, learned advocate appearing for the Commission, has submitted during the course of hearing that the Commission has agreed to accept the appellant’s offline application on 13th November 2025 at 1:00 p.m., it is directed that if such application is submitted by the appellant, the same shall be duly processed and appropriate follow-up action shall be taken in accordance with law. The appellant is directed to personally appear before the Chairman of the West Bengal School Service Commission with the offline application on the aforesaid date and time. It is made clear that this order shall not be treated as a precedent by any candidate who did not approach the authorities or file a writ petition to that effect prior to 24th September 2025. With these observation and order, the appeal and its connected application are, thus, disposed of.
