In short, the allegation against the petitioners is that on 03.04.2021 at about 03.15 p.m. respondent no.2 was driving a KSRTC bus and the petitioners were travelling in a car on the same road and due to road rage, there was an altercation between the petitioners and respondent no.2 and it resulted in petitioners assaulting respondent no.2 physically. 4. The case of the petitioners is that they did not assault respondent no.2 and it was respondent no.2 who was responsible for the incident and that a false case has been filed against the petitioners. 5. Per contra, the learned High Court Government Pleader upon instructions submits that, there is an independent witness by - 5 - HC-KAR NC: 2025:KHC:44552 CRL.P No. 2847 of 2024 way of a passenger who was travelling in the bus, who has deposed before the police that the petitioners indeed were responsible for hurling abuses at respondent no.2 and also assaulting him physically. 6. Under the circumstances, I am of the opinion that, if the allegations made in the police report are proved, the petitioners will have to be convicted for the offences alleged and whether such an incident actually took place or not is a matter to be decided in trial and it is not a fit case for this Court to interfere in exercise of its power under Section 482 of Cr.P.C. For the aforementioned reasons, the petition is hereby dismissed. In view of dismissal of main petition, pending interlocutory applications, if any, stand disposed of.
