The petitioner/wife seeks transfer of HMOP No.16 of 2025 filed by the 1/4 https://www.mhc.tn.gov.in/judis Tr.C.M.P.No.588 of 2025 respondent/husband for restitution of conjugal rights from the file of Sub Court, Vridhachalam to the file of Subordinate Court, Thiruvarur. 3. It is brought to my notice that the petitioner/wife has filed HMOP No.44 of 2024 for dissolution of marriage which is pending before Subordinate Court, Thiruvarur. 4. Learned counsel for the respondent/husband would fairly state that both the petitions have to be jointly tried and the the respondent/husband has no objection if suitable order is passed in this regard. 5. In the light of the above, considering the fact that the petitioner/wife has expressed inconvenience to travel from Thiruvarur to Vridhachalam, I am inclined to allow the transfer petition. 6. Accordingly, Tr.C.M.P is allowed and the proceedings in HMOP No.16 of 2025 pending on the file of Principal Subordinate Court, Vridhacham is withdrawn and the same is transferred to Sub Court, Thiruvarur to be tried along with HMOP No. No.44 of 2024, initiated by the petitioner/wife. 2/4 https://www.mhc.tn.gov.in/judis Tr.C.M.P.No.588 of 2025 7. The Principal Subordinate Court, Vridhachalam is directed to send the entire records relating to HMOP No.16 of 2025 to the file of Sub Court, Thiruvarur forthwith. 8. The Sub Court, Tiruvarur shall not insist the physical presence of the respondent/husband on all hearing dates, where it is absolutely necessary. At all the other hearings, the respondent/husband shall be permitted to be represented through counsel. No costs.
