ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainant has filed the present complaint alleging willful disobedience of the order dated 16.6.2025 passed by the learned Single Judge of this Court in W.P.No.17036/2025 (LB- BMP), whereby the accused were directed to stop all construction activities.
2. The complainant has drawn the attention of the Court to photographs annexed with page No.37 showing the stage of

construction as on the date of the communication of the said order. He submits that the presence of scaffolding on the building indicates that construction activities were being carried out.
3. The accused has now filed statement of objections enclosing therewith photographs. It does not indicate any material change in the structure as reflected in photographs annexed at page No.37 of the complaint. The fact that scaffolding had been raised also does not establish that the construction activity is being carried out. The photographs reflect four persons presumably workmen. However, they do not seem to be carrying out any activity at all.
4. In view of the above, we are unable to accept that the order dated 16.6.2025 is being violated.
5. The complaint is, accordingly, closed.
