For Petitioner : Mr.R.Parthiban For Respondents : Mr.V.Meganathan Government Advocate (Crl.Side) O R D E R This writ petition has been filed challenging the impugned proceedings of the 1st respondent dated 07.4.2025 and for a consequential direction to the 1st respondent to act as per the sanction order dated 08.2.2020. 2.The case of the petitioner is that they were allotted work order for supply of 129270 nos. of President's Colour Medal at a cost of Rs.1,12,46,490/- through GEM portal. The petitioner participated in the tender process and he was allotted the work. The petitioner promised that he will supply the medals in two batches. In the meantime, the petitioner met with an accident and therefore, there was some delay in supplying the medals. Time was also extended by the respondents for supply of medals. 3.The petitioner supplied the first batch of 24630 nos. of medals. The second respondent called the petitioner to the Office on 01.4.2025 and asked the petitioner to take back the medals as it was rejected. Thereafter, the petitioner was served with the impugned proceedings dated 07.4.2025. Aggrieved by the same, the present writ petition has been filed before this Court. 2/6 https://www.mhc.tn.gov.in/judis
4.The respondents have filed a counter affidavit. They have taken a stand that there was delay in supplying the medals and that apart, the medals that were supplied were inspected by the Quality Check Committee which found the medals to be of substandard quality with poor finishing and other defects were also pointed out. In view of the same, the respondents have justified the impugned proceedings dated 07.4.2025 and sought for the dismissal of this writ petition.
5.Heard Mr.R.Parthiban, learned counsel for the petitioner and Mr.V.Meganathan, learned Government Advocate (Crl.Side) appearing on behalf of the respondents. 6.In the considered view of this Court, the matter involves disputed questions of facts The petitioner is claiming that the medals that were supplied is of high quality. However, the report of the Quality Check Committee shows that the medals supplied were of substandard quality. This issue cannot be dealt with in the writ petition. That apart, in case of termination of contract, normally writ petitions cannot be entertained and the parties will have to workout their remedy only before the competent Civil Court. 7.This Court also had an opportunity to go through the entire files placed by the respondents. It is seen that the petitioner ultimately through a communication has sought for returning back the security deposit and EMD and for waiver of any further penalties. Hence, without going into the merits of the case and after considering the 3/6 https://www.mhc.tn.gov.in/judis
entire facts and circumstances of the case and the materials placed before this Court, it will suffice if a direction is given to the respondents to return back the security deposit and EMD to the petitioner within a period of four weeks from the date of receipt of copy of this order. Apart from that this Court does not find any ground to interfere with the impugned proceedings of the 1st respondent. This writ petition is disposed of with the above directions. No costs. 07.08.2025 Index : Yes/No Neutral Citation : Yes/No kp 4/6 https://www.mhc.tn.gov.in/judis
