Neutral Citation No. - 2025:AHC:111580 Court No. - 4 Case :- WRIT - A No. - 8574 of 2025 Petitioner :- Ajay Pal Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Arvind Srivastava Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Shri Arvind Srivastava, learned counsel for petitioner and learned Standing Counsel.
2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for quashing of the transfer
order dated 14.06.2025 on the ground that his daughter is undergoing treatment of kidney at New Delhi and therefore, it would be inconvenient for him to travel from Mainpuri to New Delhi.
3. It is contended that many employees who are senior to petitioner in terms of their posting at Ghaziabad and its division and yet have been retained there whereas petitioner has been transferred.
4. Learned Standing Counsel has, however, obtained instructions in the matter and I find that as per instructions petitioner had himself given a choice for as many as ten stations to be considered for transfer on 12.06.2025 and Mainpuri was one of the choices.
5. It is contended in reply by learned counsel for petitioner that petitioner was called for counseling quite late and therefore, when he applied Etawah and Mainpuri were the only choices left, however, he filled up many choices but Mainpuri has been alloted.
6. In the given facts and circumstances of the case while I decline to grant indulgence in the matter of transfer, I hereby provides that in the event petitioner makes representation before the respondent No. 3 within a period of two weeks from today, the respondent No. 3 will look into, consider the same and shall be disposing of the same within a further period of four weeks. It is further provided that while considering the request of the petitioner to be transferred to a place near Delhi or to be further retained in the Division of Ghaziabad or Agra a sympathetic consideration should
be accorded for the fact that daughter of the petitioner who is 19 years of age is undergoing treatment of kidney in Delhi.
7. With the aforesaid observations and directions the petition stands disposed of.
