25/03/2025 Heard Ms. S Yesmin, learned counsel appearing on behalf of Mr. D Medhi, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam for the State respondent. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Manisha Murmu, wife of Sri Bobisan Murmu, resident of Lokhra Senmela, P.S. Garchuk, District-
Page No.# 2/3 Kamrup (Metro), seeking bail in Gorchuk P.S. Case No. 22/2025 registered under Sections 21(b) of NDPS Act corresponding to G.R. No. 385/2025, wherein she was arrested on 24.01.2025 and is in custody since then. 3. 1.34 Nos. of vials suspected to be Heroin, total weight with vials of 44.83 gms. was recovered from the conscious possession of the petitioner. 4. The petitioner was taken into custody on 24.01.2025 in connection with Gorchuk P.S. Case No. 22/2025 and was produced before the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati on 24.01.2025 itself. 5. Perused the case diary placed before the Court today by Mr. Goswami, learned Additional Public Prosecutor, Assam. 6. It is seen that since 24.01.2025, till date, the petitioner is in custody for 60 (sixty) days, but the charge-sheet in the case has not yet been filed due to non-availability of the FSL report. 7. As the petitioner has already completed the statutory/mandatory period of her detention in custody and the prosecution has failed to file charge-sheet in the case, the petitioner is entitled for her default bail in said Gorchuk P.S. Case No. 22/2025. 8.
Accordingly, the petitioner, namely, Manisha Murmu, wife of Sri Bobisan Murmu is granted default bail in said Gorchuk P.S. Case No. 22/2025 registered under Sections 21(b) of NDPS Act corresponding to G.R. No. 385/2025, on furnishing a bail bond of Rs.75,000/- with 2 (two) local sureties each of the like amount to the satisfaction of the learned Special Judge (NDPS)-cum-Sessions Judge, Kamrup (Metro), Guwahati on conditions that the petitioner — (i) shall appear before the Investigating Officer of said Gorchuk P.S. Case No. 22/2025 as and when she is required for necessary investigation of the case; (ii) shall not leave the territorial jurisdiction of the learned Special Judge (NDPS)-cum-Sessions Judge, Kamrup (Metro), Guwahati without obtaining prior written permission from the said authority; (iii) shall not hamper with the investigation, or tamper with the evidence of the case; (iv) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; and (v) shall not involve herself in any criminal activities in future including possession or procurement, transportation and selling etc. of such NDPS items; failing which, the bail granted to her in the aforesaid Gorchuk P.S. Case No. 22/2025 shall stand automatically vacated. Page No.# 3/3
