JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners/accused Nos.3 and 4 have preferred this petition under Section 483 of BNSS, 2023, to enlarge them on bail in Cr.No.569/2025 of K.R.Puram Police Station, Bengaluru City. 2. In the complaint lodged by one Nagendra Babu, it is alleged that on 10.7.2025, he along with his friends had gone to one Priyanka Nagar Thopu in Shegehalli, K.R.Puram, Bengaluru City, to have drinks, at that time, one Shiva came where they had parked their vehicle and tried to assault his friend Rudra with a chopper, but Rudra - 3 - HC-KAR NC: 2025:KHC:36608 CRL.P No. 12403 of 2025 managed to escape and fled the scene. The said accused then assaulted him on his hands, head and back. 3. Injured complainant was shifted to Government Hospital and then to Victoria Hospital wherein he took treatment for the injuries sustained by him. 4. It is alleged that when the complainant along with his friends had been to Priyanknagar Thopu for having drinks, accused by name Shiva and his friends assaulted him with chopper etc. A perusal of the complaint averments clearly goes to show that he was assaulted only by Shiva and not others. He has specifically stated that two others who were present along with Shiva did not assault him. In FIR, petitioners are not named as accused. It appears that on the voluntary statement of accused No.1, petitioners are arraigned as accused in this case. Chargesheet is filed against accused Nos.1 to 4. Petitioners are arraigned as accused Nos.3 and 4 respectively. They are in custody from 15.7.2025. - 4 - HC-KAR NC: 2025:KHC:36608 CRL.P No. 12403 of 2025 4. The learned High Court Government Pleader contended that there are other criminal cases registered against accused No.3. However, in the case on had, there are no specific allegations against the petitioners that they have assaulted the complainant. It is also not alleged that they were armed with weapons at the time of alleged incident. Investigation is completed and the chargesheet is already filed. Hence, the following: ORDER I. Petition is allowed. II. Petitioners/accused Nos.3 and 4 in Crime No.569/2025 of K.R.Puram Police Station, Bengaluru City, shall be enlarged on bail, subject to following conditions: 1. They shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each, with two sureties for the likesum to the satisfaction of the jurisdictional Court. - 5 - HC-KAR NC: 2025:KHC:36608 CRL.P No. 12403 of 2025 2. They shall furnish their residential address and shall inform the Court, if there is change in the address. 3. They shall not directly or indirectly tamper with the prosecution witnesses. 4.
