1. The present petition has been filed under Section 483 BNSS read with Section 528 of BNSS, 2023 for grant of interim bail to the petitioner for a period of 03 months on medical grounds in FIR No.158 dated 04.10.2020, under Section 22-C of NDPS Act 1985, registered at Police Station Guhla, District Kaithal.
2. In the light of short reply filed by way of an affidavit of Kuldeep Beniwal, DSP, Guhla, it is evident that the petitioner had been advised laparoscopic repair of incisional hernia and the date fixed for the surgery is 09.07.2025, a detailed para of which is reproduced hereinbelow:-
“The petitioner was then taken to Mittal Surgical and Maternity Hospital, Kaithal, where he was diagnosed as a case of recurrent incisional hernia and was advised ‘laparoscopic repair of incisional hernia’, which an estimate NISHA 2025.07.04 19:16 I attest to the accuracy and integrity of this document
CRM-M-31581-2025 -2- cost of Rs.70,000/-. The petitioner was further advised by the treating doctor that he may be operated on 09.07.2025.”

After going through the reply in hand, this Court would be inclined to accept the prayer for grant of interim bail to the petitioner on account of the aforesaid surgery and by considering the fact that post surgery stitches are to be inflicted and extra caution is required along with rest for couple of weeks as per medical advise.

In the light of such prevailing circumstances and the medical opinion emerging out of status report filed by the State dated 30.06.2025, the petition is allowed and the petitioner is directed to be released on interim bail for a period of 06 weeks which shall commence from tomorrow i.e. 05.07.2025 and the petitioner shall surrender hence on 18.08.2025 by 05:00 PM before the concerned jail authorities.
5. In the abovesaid terms, petition is allowed.
