Mr. Amar Murti Shukla, learned counsel for the petitioner.
2. Mr. B.C. Joshi, learned AGA for the State.
3. By means of present writ petition, petitioner has sought the following reliefs:-
“(i) Issue a writ, order or direction in the nature of mandamus to transfer the investigation in relation to the FIR No.0012 of 2025, P.S. Mori, District Uttarkashi, dated 30.03.2025 to some independent agency in order to conduct fair and proper investigation in the matter. (ii) Issue a writ, order or direction in the nature o of mandamus directing the respondent no.4 to produce progress report of investigation in relation to the FIR No.0012/2025, P.S. Mori, District Uttarkashi, dated 30.03.2025.”
4. Vide order dated 17.06.2025, instructions were called from the State with regard to the progress of the investigation.
5. Today, learned State Counsel supplied the instructions dated 02.07.2025 along with final report to the Court. The same is taken on record. On instructions, learned State Counsel submits that after investigation, final report has been submitted in favour of the accused named in the first information report.

Learned counsel for the petitioner submits that he was apprehending such kind of filing of the final report, therefore, in the present writ
2 petition, he has prayed for transfer of the investigation to some independent agency to conduct fair and proper investigation.
7. Having considered the submissions of the
learned counsel for the parties, this Court is of the view that since the final report has been filed by the investigating officer, the petitioner- informant has got legal recourse to file a protest petition to the final report, once he receives notice from the learned trial court.
8. In this view of the matter, it will not be proper to transfer the investigation at this stage when the final report has been submitted. Accordingly, the present writ petition is hereby closed.
9. However, the petitioner is at liberty to seek legal recourse as available under the Code/ BNSS, 2023.
