ORAL ORDER
The present writ petition is filed seeking the following prayer:
“(a) Issue a writ of appropriate nature to set aside the auction notice dated 24.10.2024, at Annexure-E, issued by the respondent in respect of the property bearing No.9/3 ward No.48 situated at Lalbagh main road, next to MTR hotel, Bangalore-560027, also called as Kishna Towers, No.9/3, Lalbagh main Road, Sudham Nagar, Bangalore-560027; and (b) Pass such other orders as this Hon'ble Court may deem fir and proper under the circumstances of the case, in the ends of justice and equity.”

On the last occasion i.e., on 09.12.2025 when the matter came up, the learned senior counsel appearing for the petitioner submitted that the petitioner is approaching the respondent/bank for ‘One Time Settlement’ and the petitioner will be withdrawing the petition on 15.12.2025. Learned senior counsel submits that they are waiting to settle the same with the bank by paying the entire amount through OTS.

Learned counsel appearing for the respondent/bank submits that if the petitioner comes up with a proposal, within one week from the date of proposal they will consider and it is

also submitted that till two weeks from today they will not take any coercive steps in respect of the property involved in the writ petition. Hence, this Court deems it appropriate to pass the following:
ORDER i. Accordingly, writ petition is disposed of. ii. All IA’s in this petition shall stand closed.
