Petitioner has sought for issuance of writ in the nature of mandamus to direct the respondents for grant of emergency parole to her husband.
2. Petitioner is the wife of the convict. It is submitted that the convict is suffering from spinal cord disc bulge at L3-L4, L4-L5 and L-5-S1 and is taking

HC-KAR NC: 2025:KHC:27036 WP No. 20663 of 2025 continuous treatment. It is submitted that the convict on an earlier occasion was enlarged on parole pursuant to the
order passed in W.P.No. 14551/2025. However, the operation could not be performed as there were certain practical difficulties in arranging funds. It is submitted that now arrangements have been made and accordingly the convict may be enlarged on parole so as to enable performance of operation.
3. A memo is filed by the learned counsel for petitioner enclosing copy of the medical report sent to the Chief Superintendent of Central Prison by the Chief Medical Officer, Central Prison. The same, if perused would indicate the ailment as asserted.
4. Learned Additional Government Advocate upon instructions submits that the medical ailment of the petitioner's husband has been verified from the concerned.
5. In light of the same, the convict is enlarged on parole for a period of 3 weeks from the date of release.

HC-KAR NC: 2025:KHC:27036 WP No. 20663 of 2025 The convict may be released on 21.07.2025 and the period of 3 weeks to be counted from such date. The Chief Superintendent of Central Prison is entitled to impose necessary conditions as may be required to ensure that the convict returns back.
