ORAL ORDER
The petitioner is before this Court seeking to quash the notice dated 19.02.2022 issued by respondent No.4 - the Recovery Officer for auction under Section 101(b) Rule 38(a)(3 and 4) of the Karnataka Cooperative Societies Act, to transfer the rights to respondent No.3 - Bank as per Annexure-E.

Learned counsel for respondent No.3 submits that the petition is not maintainable as efficacious remedy available under Section 101(2) of the Karnataka Co-operative Societies Act, 1959, is not availed by the petitioner and without exhausting the said statutory remedy, he cannot approach this Court.

Learned counsel for the petitioner does not dispute the said contention raised by learned counsel for respondent No.3. He fairly concedes that the petitioner will invoke Section 101(2) of the Karnataka Co-operative Societies Act, 1959.

Submissions are placed on record.
6. In view of the above, I proceed to pass the following:
ORDER i) Writ petition is disposed off.

ii) The petitioner is at liberty to approach the Registrar of Karnataka Co-operative Societies with his objection to Annexure-E. iii) Respondent No.4 is directed to consider the objections that may be filed by the petitioner, in accordance with law, within a reasonable time. iv) The petitioner shall appear before respondent No.4 on 01.12.2025 at 03.00 p.m. v) Till that date, respondent No.4 shall not precipitate the matter.
