This application u/s 528 BNSS has been filed for quashing of the entire proceedings, including charge-sheet no. 289/2022 dated 09.09.2022 as well as cognizance order dated 20.10.2022, of Criminal Case No. 5349/2022 (State v. Babli and others), arising out of Case Crime No. 427/2021, under Sections 193, 120-B, 420 of IPC, P.S.- Jalesar, District- Etah, pending in the court of Additional Chief Judicial Magistrate, Jalesar, Etah. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and applicant is willing to appear before the trial court concerned and a direction may be made to the court concerned to decide the bail application of applicant expeditiously in accordance with law laid down in the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another, 2022 SCC OnLine SC 825. 4. In view of the aforesaid, it is directed that in case, applicant appears/surrenders before the trial court concerned within a period of four weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with settled law. For a period of four weeks from today or till the applicant appears/surrenders before the court concerned, whichever is earlier, no coercive action shall be taken against the applicant in the aforesaid case. 5. The application u/s 528 BNSS is finally disposed of in above terms.
